These Terms of Service (“Terms”) govern your access to and use of the Fanaply Festival App (“App”), which is owned and operated by FanOP Entertainment Inc. (“Fanaply,” “we,” “us,” or “our”). By using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

To access the App, you must register using your mobile phone number and verify your identity via two-factor authentication (2FA). You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

By using the App, you consent to the collection of personal information including your name, phone number, email address, age, gender, and zip code. This data may be used by Fanaply to provide services through the App, administer contests and promotions, and deliver rewards and discounts. We may also use this data internally and license aggregated, anonymized insights to our business partners as part of our EngageIQ data intelligence platform.

You also acknowledge and agree that Fanaply may use your personal information—including behavioral data collected through your participation in our challenges, activities, or mobile platform—for internal analysis and for creating aggregated, anonymized, or enriched data sets.

Subject to applicable laws and your consent, we may share or license this data, including linkages to identifiers such as email address or phone number, to trusted third parties for lawful commercial purposes, such as audience segmentation, measurement, and personalization.

The App allows you to earn points, rewards, discounts, or entries into contests for completing activities such as checking in at locations or engaging with sponsor activations. Fanaply makes no guarantees regarding the availability, quality, or delivery of third-party rewards. All rewards are subject to availability and may be changed or discontinued at any time.

You agree to use the App only for lawful purposes and in accordance with these Terms. You will not:• Use the App to transmit or upload any unlawful, harmful, defamatory, or otherwise objectionable material;• Interfere with the operation of the App or attempt to gain unauthorized access to our systems;• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.

By registering with your phone number, you may opt-in to receive marketing messages via SMS. Message and data rates may apply. You may opt-out at any time by replying STOP to any of our messages.

Fanaply reserves the right to suspend or terminate your account or access to the App at any time, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful to the App, other users, or our partners.

The App is provided “as is” and “as available” without warranties of any kind. Fanaply disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Fanaply shall not be liable for any indirect, incidental, or consequential damages resulting from your use of the App.

These Terms are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles.
